The Business Immigration Program is designed to encourage and facilitate the admission of these individuals. Both the federal and provincial/territorial governments welcome business immigrants and offer services to help immigrants start a business and settle in Canada. Nonetheless, the Entrepreneur and Immigrant Investor Programs are under a moratorium since July 2011 and July 2012 respectively, with no view in sight of being re-opened.  


On 19 June 2014, Citizenship and Immigration Canada announced that the applications that received a selection decision before 11 February 2014 would not be affected by the termination and continued to be processed to the end. But, the applications where a selection decision was not made before 11 February 2014 were terminated, as a result, all fees paid to CIC were refunded, and the investment, if applicable, was also refunded.


Current Categories for Business Visas in Canada are:


FEDERAL START-UP VISA: 

The requirements for applicants under the Start-up Business Class are as follows 

  • Commitment from a Designated Entity
  • Ability in English, French or both
  • Settlement Funds

If you meet all three requirements indicated above, then you may qualify to immigrate to Canada under the Start-up Business Class.


SELF-EMPLOYED CLASS:

To be a member of the self-employed class, the applicant must have a minimum of two years of experience in cultural activities, athletics, or the purchase and management of a farm (for applications received before March 10, 2018), during the period beginning five years before the date of application for a permanent resident visa and ending on the day a determination is made in respect of the application.


ONTARIO INVESTOR PROGRAM:

Ontario Immigrant Nominee Program (OINP) has re-designed its Business stream options.  They now have two streams open for business, Entrepreneur and Corporate. 


Entrepreneur Stream: The following are the requirements:


  • New Businesses
  • Purchasing an Existing Business


Corporate Stream: The OINP Corporate stream assists established international corporations to expand into Ontario or buy an existing business. Key corporation staff are eligible to apply for nomination and then permanent residence under this stream.


The following are the eligibility requirements for this stream:

  • Business must have been established outside Canada for at least 3 years before applying;
  • Corporations must invest a minimum of $5 million in a new or existing business;
  • Key staff seeking nomination must be currently employed with the corporation and be essential to the operation of the business in Ontario.  They must also meet a minimum CLB 5 level or equivalent in either English or French;
  • Creation of five full-time, permanent positions for Canadian citizens or permanent residents per nominee;
  • Key staff nominees will have two years to demonstrate a minimum language requirement before permanent residence nomination
  • Other criteria will apply
